A district is not equally open as required by Section 2 of the Voting Rights Act when minority voters (unlike their majority peers) face bloc voting along racial lines, arising against the backdrop of substantial racial discrimination within the state, that renders a minority vote unequal to a vote by a non-minority voter.
Voting Rights and Election Law at the Court
The Court issued two significant election-law rulings this term, both in the context of redistricting. One of the cases, Allen v. Milligan, addressed how plaintiffs can challenge a state legislature's congressional map under the Voting Rights Act. The other, Moore v. Harper, considered the sweep of a state legislature's authority to draw congressional districts under the Constitution's Elections Clause. In both cases, the Court rejected the novel and sweeping arguments of the state legislatures and ruled in favor of the voters.
